GENERAL CONDITIONS OF USE AND CONTRACT

These General Conditions of Use and Contract govern access to and use of the website accessible through the domain name https://daytrips.com.es/, as well as the booking of tickets, activities, excursions and transfers through it.

Merely accessing the website confers on the user the status of website user and implies acceptance of all the terms and conditions contained in these general terms and conditions. Users are advised to read the Terms and Conditions of Use and the Contract carefully each time they access the Website.

I.- WEBSITE OWNER 

In accordance with Article 10 of Law 34/2002, of 11 July, on Services of the Information Society and Electronic Commerce, the following information is provided on the owner of this website:

  1. PURPOSE 

The purpose of these general conditions is to define the legal conditions applicable to the purchase and sale of tickets, activities, excursions and transfers published on the website (hereinafter referred to as “Events”). Daytrips acts only as an intermediary between the organisers of the Events and/or Services and the purchasers (Users or Clients) of these services. Daytrips is not the organiser and does not participate in any organisational aspect of the Events or Services.

III.- GENERAL INFORMATION

 The User or Client is hereby informed of these General Terms and Conditions, of which he/she has been informed prior to the initiation of the contracting process.

By means of these general conditions, the User is informed that Daytrips may modify the content of these general conditions and any specific conditions that may exist at any time and without prior notice.

The User declares that he/she is of legal age (over 18 years old) and that he/she has the necessary capacity to contract the events offered by the Organisers on the Daytrips website, in accordance with these General Terms and Conditions, which he/she declares to have understood and accepted.

  1. PURCHASE PROCESS 
  2. Selection and booking of the event 

On the website, the User can select the event he/she wishes to purchase. If applicable, the User must provide the requested information regarding the date and time of the event and the number of participants. The User must then complete the form with the necessary personal information, including that of the User and any third parties involved in the reservation, in order to complete the payment. Finally, the User must complete his/her bank details and confirm the payment through the payment platform. Once the above steps have been completed, the purchase process is complete. The event will only be purchased by the user once the payment has been accepted by the bank. If this process is not completed successfully, the event reservation will be released.

2.- Receipt of event tickets 

Once the above process has been successfully completed, the customer will receive the event tickets or vouchers purchased in PDF format at the email address provided in the form. These tickets can be printed at home (Print at Home system). Clients can also access the event with a mobile voucher if this is specified in the excursion description in the Requirements section for each event. The document obtained is fully valid and allows access to the event offered by the Organiser.

  1. EVENT FEATURES

In the Daytrips e-commerce environment, the User can purchase different Events. The description of each Event, as well as its prices and rates, can be found by selecting the Event of interest.

The User can consult the specific rules for each Event in its respective listing on the website.

The full final price of each event is indicated, including taxes and any other additional charges, as well as any applicable discounts and any surcharges or increases corresponding to complementary or special transactions.

Daytrips publishes information about the different events offered on the website as up-to-date as possible and in all cases according to the information provided by the organiser.

 

VI.- WARRANTIES 

Daytrips acts only as an independent intermediary between the user and the organisers. In the event of an incident, the User must contact Daytrips as soon as possible, who will contact the Organiser in order to adopt the appropriate solutions. The Organisers are responsible for the correct execution of the contracted services and the User will indemnify Daytrips.

Daytrips will provide the User, upon request, with official complaint forms and, if necessary, electronic forms, in order to facilitate the proper protection of the User’s rights.

VII. CANCELLATION POLICY

Each Event has its own cancellation policy. The User must review each Event individually, with the applicable cancellation conditions detailed in the Event information.

No-shows on the day and time stipulated for the contracted Event will be considered, for all purposes, as a cancellation of the on-site service. Consequently, the cancellation policy will apply with less than 48 hours’ notice. No refunds or changes to the service will be permitted, unless otherwise agreed in writing by the Organizer and the User.

The inability to attend the contracted Event or the commission of an error at the time of purchase by the Client will not be grounds for a change or refund of the amount paid, unless otherwise stipulated in the cancellation policy for each Event. In the event of cancellation, the Client must contact us by sending an email to support@daytrips.com.es within the timeframe stipulated for each event. In the case of a refund, it will be issued using the same payment method used to pay for the purchase, within a maximum of 15 business days from the date the claim is accepted.

VIII.- EXCLUSION OF LIABILITY 

Daytrips declines any liability that may arise from the user’s improper use of the website and the online purchase process, as well as any liability for damages caused by third parties that are not directly attributable to Daytrips.

 

Daytrips shall not be liable for any unforeseen events that may occur during the execution of the Events, including delays, errors, malfunctions and, in general, any other inconveniences that may occur due to causes beyond the control of Daytrips and/or due to the malicious or negligent conduct of the User and/or due to force majeure or unforeseeable circumstances.

Regarding external links or hyperlinks to Daytrips, if any, they are for informational purposes only and are not under the control of Daytrips and therefore Daytrips is not responsible for the information contained therein.

IX.- PERSONAL DATA PROTECTION 

In accordance with current legislation on data protection, any personal data provided during the use of the website will be treated in accordance with our Privacy Policy, which all users will be deemed to have read and accepted from the moment they access the website.

Daytrips offers events provided by various organisers and will therefore share users’ personal data with said organisers for the purposes of properly providing the contracted services and in accordance with the confidentiality obligations compatible with our Privacy Policy.

X.- VALIDITY OF THE CONTRACT

 If any of the clauses of these General Conditions or of the Specific Conditions of each Event should be considered null and void or unenforceable, this shall not affect the other clauses, which shall remain in full force and effect.

XI.- APPLICABLE LAW AND JURISDICTION

 The User accepts that the operation of this website and the services offered by Daytrips are governed by Spanish law. The Courts and Tribunals of the User’s domicile, in their capacity as consumer, shall be competent to hear any dispute arising from the interpretation or application of these General Conditions.
